1. Introduction and definitions

Duckfund (as defined below) provides financial products and services solely for business or commercial purposes to sole proprietorships, businesses and other entities ("Commercial Customers"). Our services are not directed to or intended for individuals under 18 years of age.

Contact us if you believe that we have mistakenly collected personal data from someone who is not allowed to use our services or who intends to use financial products and services from Duckfund for personal, family, or household purposes and we will delete this information immediately unless we are legally required to keep it. This Policy will apply to all Affiliates of Duckfund, now existing or hereafter arising.

This Policy applies to you, whether you are a current, past or prospective Commercial Customer. It also applies to third parties whose Company Information you provide to us in connection with our relationship with you (for example, the names of company’s officers). Please ensure that you provide a copy of this Privacy Policy to any third parties whose Company Information you provide to us.

For purposes of this Policy, "Company Information" means any information about a Commercial Customer from which the Commercial Customer could be identified, whether obtained directly from the Commercial Customer or from another source. Company Information may include, but is not limited to: (a) company name, your contact information such as name, email address, mailing address, phone number; (b) physical address, including street name and name of city or town; (c) email address or other electronic contact information; (d) telephone number; (e) tax identification number; (f) credit history; (g) bank or credit card account number; (h) financial statements; (i) information about officers, directors, and other control persons; and (j) any other information from or about a Commercial Customer. However, the following is not considered Company Information: (a) aggregated or anonymous information that does not identify a customer and (b) information that Duckfund obtains from a public source (or knows to be available from a public source).

“Duckfund” and “we” in this Policy means Duckfund Inc., a Delaware corporation.“Website” in this Policy means duckfund.com. “Affiliates” in this Policy means companies related by common ownership or control. They can be financial and nonfinancial companies.“Nonaffiliates” in this Policy means companies not related by common ownership or control. They can be financial and nonfinancial companies and could include insurance companies, mortgage companies, credit card companies and direct marketing companies.

Duckfund Inc. PRIVACY POLICY 120322 may make changes to this Policy from time to time. It is available to you at Privacy and Security page. Under certain circumstances (i.e., with respect to material changes to this Policy), we may also elect to notify you through additional means, such as by posting a notice on the Website or sending you an email. We encourage you to periodically review this page for the latest information on our privacy practices. By continuing to use our Services, you are confirming that you have read and understood the latest version of our privacy policy.

2. Information collected

In order for us to provide the product or service you have requested of us, to give you information on financial products and to facilitate third party financing for you, we need to collect and process Company Information about you. If you do not provide the Company Information we need, we may not be able to provide our services to you.

The purpose of processing your Company Information:
  • To give you information on and obtain offers of financial products for you from third parties.
  • To fulfill your requests for certain products and services.
  • To third-party contractors that provide services to Duckfund and are bound by these same privacy restrictions;
  • To comply with legal and regulatory requirements including Anti-Money Laundering and Sanctions compliance, to combat fraud and to protect your Company Information.
  • To understand how people interact with our Website, to enhance your user experience and to provide technical and customer support.
  • To carry out and determine the effectiveness of advertising, and of marketing campaigns.
  • Other purposes for which we seek your consent.
We may gather and retain Company Information about Commercial Customers from the following sources:
  • Applications or other forms that you provide to us;
  • Account activity and transactions (such as payment history, account balances, customer support requests, feedback, and usage);
  • Credit-related information from credit reporting agencies;
  • Information from Website visits (such as content or other information that you may provide or create when you interact with our Website, usage and transaction history, and other technical data that we use for security purposes and to enhance the online experience). For example, we collect IP addresses to track and aggregate non-personal Company Information, such as using IP addresses to monitor the regions from which users navigate to our Website. We also collect IP addresses from users when they log into the Website as part of our log-in and security features.
  • Information we receive upon your consent from third parties such as banks, providers of accounting software, payment processors and other entities.

Our services may change over time and we may introduce new features that may collect new or different types of Company Information.

If we have Company Information from you or Company Information that is available from other sources, including from third parties from both offline and online sources, we may use it in combination with the information that we have collected through our Website. We can use this information to better tailor and personalize our services and communications to you, both online and offline, and for any other purpose that complies with applicable law and regulation.

By submitting your Company Information, you expressly authorize Duckfund and any of its Affiliates to use that Company Information in accordance with their respective privacy policies.

Any Company Information that Duckfund collects is kept as long as necessary to fulfill the purposes outlined in this Policy, unless a longer retention period is required by law or our recordkeeping policies and practices. When we no longer have reason to retain your Company Information it will be destroyed or anonymized in a manner designed to preserve its private and confidential nature, however archival copies may be impossible to delete.

3. Sharing of company information

Duckfund shares Company Information among and between all of its Affiliates. You may not opt-out of this sharing.

Duckfund may share Company Information with Nonaffiliates in order to offer you additional products and services. You have the right to opt-out of such sharing, as described below in "How To Change Your Privacy Options."

Duckfund may also disclose Company Information to Nonaffiliates for routine business purposes, including but not limited to website design, sending email communications, fraud detection and prevention, customer care, or performing analytics. For example, Duckfund may disclose Company Information to service providers and other third parties as necessary to facilitate a transaction requested by a Commercial Customer, or to report to credit bureaus, or to organizations or firms who provide consulting, technology or other services for us and agree to maintain its confidentiality, to only act on our behalf and under our instructions, and to not use Company Information for purposes other than the product or service they are providing to us or on our behalf.

Please be aware that third-party websites accessible or recommended through our Services may have their own privacy and data collection policies and practices. These links and features are provided for your reference and convenience only and do not imply any endorsement of information provided through these third-party links and features, nor any association with their operators. We are not responsible for any actions, content of websites, or privacy policies of such third parties. We urge you to read the privacy and security policies of these third parties.

Duckfund uses Plaid Inc. (“Plaid”) to gather your data from financial institutions. By using the Website, you grant Duckfund and Plaid the right, power, and authority to act on your behalf to access and transmit your personal and financial information from your relevant financial institution. You agree to your personal and financial information being transferred, stored, and processed by Plaid in accordance with the Plaid end user privacy policy.

We restrict access to your Company Information to our employees and to permitted third-parties who need to know that information to provide products or services for us, or to provide, process, or maintain any security, account, or financial product, service or program for you or your benefit.

Duckfund may also disclose Company Information to Nonaffiliates in response to a subpoena, warrant, or court order, or as otherwise required or advisable considering applicable law or regulation. You may not opt-out of this sharing. Further, Duckfund may disclose Company Information to its banking, securities, or other regulators without any prior notification or any other restriction.

We may also use and share Company Information that we collect on an aggregate or anonymous basis (such that it does not identify any individual users) for various business purposes with Nonaffiliates, where permissible under applicable laws and regulations. Only in a way that would not allow you or any other person to be identified, we may prepare and share anonymized Company Information with third parties, such as banks, financial companies, advertisers or partners, for purposes of identifying and informing you about financial products available for you as well as for research, academic, marketing and/or promotional purposes. If you are a California resident, we will not share your Company Information with third parties for their marketing purposes without your consent.

4. How to change your privacy options

We will share Company Information as described in Section III above unless you direct us otherwise by taking a step below. Note that based on the sharing practices above, there are certain instances of sharing for which you may not opt out.

  • Contact compliance@duckfund.com Include the words “Opt Out” in the subject line and body of your email. Requests must include company name, address, contact telephone number, tax identification number (TIN), and account number(s) (if applicable) for the business entity(ies) opting out. Incomplete information will delay or possibly prevent our ability to honor your request.

Our system will be updated to reflect your privacy preferences within thirty (30) days following receipt of the request with complete information. You can verify the update by calling the Customer Service number listed above.

If you have already shared with us your privacy preferences under this Policy, it is not necessary to contact us again. We will continue to honor the preferences you have provided.

5. Security

To protect your Company Information from unauthorized access and use, Duckfund uses use security measures that comply with federal law. These measures include computer safeguards and secured files and buildings.

6. Your california privacy rights

If you are a California resident, you may have certain rights. California law may permit you to request that we:

  • Provide you the categories of personal information we have collected or disclosed about you in the last twelve months; the categories of sources of such information; the business or commercial purpose for collecting or selling your personal information; and the categories of third parties with whom we shared personal information.
  • Provide access to and/or a copy of certain information we hold about you.
  • Delete certain information we have about you.
  • Opt you out of the sale of your personal information. As noted below, we do not "sell" your personal information, as that term is defined by the CCPA.

You may have the right to receive information about the financial incentives that we offer to you for your personal information (if any). You also have the right to not be discriminated against (as provided for in applicable law) for exercising certain of your rights. Certain information may be exempt from such requests under applicable law. For example, we need certain types of information so that we can provide the Services to you and for compliance with applicable law. If you ask us to delete certain information, you may no longer be able to access or use the Services.

To exercise your rights, please send us an email at compliance@duckfund.com. You will need to provide additional information to verify your identity before we fulfill your request. You can also designate an authorized agent to make a request on your behalf. To do so, you must provide us with written authorization or a power of attorney, signed by you, for the agent to act on your behalf. You will still need to verify your identity directly with us.

The CCPA sets forth certain obligations for businesses that "sell" personal information. Based on the definition of "sell" under the CCPA and under current regulatory guidance, we do not believe we engage in such activity and have not engaged in such activity in the past twelve months. We share certain information as set forth in the Information Use and Sharing section, above.

California Shine the Light Disclosure

The California "Shine the Light" law gives residents of California the right under certain circumstances to opt out of the sharing of certain categories of personal information (as defined in the Shine the Light law) with third parties for their direct marketing purposes. We do not share your personal information with third parties for their own direct marketing purposes within the meaning of that law.

7. Information for nevada residents

Certain Nevada users may opt out of the sale of "personally identifiable information" for "monetary consideration," as defined under Nevada law, to a person for that person to license or sell such information to others. We do not engage in such activity; however, if you are a Nevada resident who has purchased goods or services from us, you may submit a request to opt out of any future sales under Nevada law by contacting us as detailed in the "Contact Us" section. Please note we may take reasonable steps to verify your identity and the authenticity of the request.
